1. Acceptance of Terms

By accessing or using the website www.childrensgarden.com.bd (the “Website”), you agree to be
bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms,
you must not use this Website.

These Terms constitute a legally binding agreement between you (“User”) and Children’s Garden
(“the School”) under the Contract Act, 1872 of Bangladesh.
The School reserves the right to modify these Terms at any time. Continued use of the Website after
any modification constitutes acceptance of the updated Terms.

2. About the School and This Website

Children’s Garden is a privately held kindergarten operating on a partnership basis at 25/6 Block-C,
Tajmahal Road, Mohammadpur, Dhaka-1207, Bangladesh, established in 1992.
This Website provides information about the School, facilitates admissions enquiries, showcases
alumni success stories, shares school activities and facilities, and serves as a communication
resource for the school community.

The Website does not constitute a binding offer of admission. Admission to Children’s Garden is
subject to availability, the School’s admission criteria, and a separate formal admission process
governed by the School’s internal policies.

3. Eligibility

  • This Website may be freely accessed by any member of the public.
  • To submit an enquiry form or alumni story, you must be at least 18 years of age.
  • To submit an alumni story or photograph involving a minor, you must be the child’s parent or
    legal guardian, or must hold the explicit written consent of the parent or legal guardian.
  • If you are submitting information on behalf of another person, you confirm that you have their
    permission to do so.

4. Accuracy of Information on the Website

  • We endeavour to keep all information on this Website accurate and current. However, fee
    structures, admission dates, and school calendar events are subject to change without
    advance notice on the Website.
  • You should always confirm current fees, admission procedures, and event dates by
    contacting the School directly before making any decision based on information published on
    this Website
  • The School accepts no liability for any loss or damage caused by reliance on information
    found on this Website.

5. Alumni Story Submissions

5.1 Submission and Approval Process

  • Your submission does not guarantee publication. All submissions are reviewed and approved
    by an authorised administrator of the School before publication.
  • The School may edit your story for length, clarity, or appropriateness prior to publication.
  • The School may decline to publish any submission at its sole discretion and without providing
    reasons.
  • Once published, your story will remain on the Website until you request its removal.
  • You may request removal at any time by contacting info@childrensgarden.com.bd. We will
    remove the story within 14 working days.

5.2 Licence Granted to the School

By submitting a story and/or photographs, you grant Children’s Garden a non-exclusive, royalty-free licence to:
  • Publish the story and photograph(s) on this Website
  • Share the story and photograph(s) on the School’s official Facebook page and WhatsApp channel
  • Use the story and photograph(s) in the School’s printed promotional materials including brochures and leaflets
This licence remains in effect until you request removal of your content. Materials already distributed in print cannot be recalled, but the School will cease all future digital and print use upon your request.

5.3 Your Warranties

By submitting content, you warrant that:

  • The story is truthful and accurate to the best of your knowledge.
  • You own or have the legal right to submit any photographs, and those photographs do not
    infringe the copyright or other intellectual property rights of any third party.
  • If photographs depict a minor, you are the child’s parent or legal guardian, or have obtained
    explicit written consent from the parent or legal guardian.
  • The content does not contain anything defamatory, unlawful, or in violation of any applicable
    law of Bangladesh, including the Cyber Security Act, 2023.
  • You indemnify the School against any claim, loss, or liability arising from a breach of these
    warranties.

6. Photo Archive

The School maintains a Photo Archive of historical school photographs uploaded by the School
administration from its own records.

  • Parents or guardians of students appearing in archived photographs who wish to have
    specific images removed may contact us at info@childrensgarden.com.bd. We will action
    such requests within 14 working days.
  • Photographs in the archive are protected by copyright and may not be downloaded,
    reproduced, or shared without the School’s prior written consent.

7. School Calendar

The School Calendar section lists planned events and activities. All dates and events are indicative
only and subject to change. The School accepts no liability for inconvenience caused by any change
to published calendar events.

8. Contact Forms and WhatsApp

  • By submitting a contact form or initiating a WhatsApp conversation, you consent to the School
    contacting you in response via the phone or WhatsApp number you have provided.
  • Communication via WhatsApp is subject to the terms and privacy policy of Meta Platforms,
    Inc.
  • The School will not add you to any bulk broadcast or marketing list without your separate
    express consent.

9. Intellectual Property

All content on this Website — including text, graphics, the Children’s Garden logo, photographs taken
by the School, design elements, and the Website’s overall design — is the intellectual property of
Children’s Garden or its licensors.

  • You may not reproduce, republish, distribute, transmit, or commercially exploit any content

  • The Children’s Garden name and logo are protected marks. You may not use them without

17. Governing Law and Jurisdiction

These Terms and Conditions are governed exclusively by the laws of the People’s Republic of
Bangladesh.
Any dispute, controversy, or claim arising out of or in connection with these Terms — including any
question regarding their existence, validity, or termination — shall be submitted to the exclusive
jurisdiction of the competent courts of Dhaka, Bangladesh.
